Welcome to OddsWire, a sports betting data analytics and market intelligence platform operated by OddsWire LLC. These Terms of Service govern your access to and use of the OddsWire service. By accessing or using OddsWire, you agree to be bound by these terms. If you do not agree, you may not use the service.

1. Service Description

OddsWire provides real-time sports betting data analytics, prediction market arbitrage detection, and market intelligence tools. Our service aggregates data from multiple sources including Kalshi, Polymarket, ESPN, and six major sportsbooks. We offer three subscription tiers:

✓Pro Trader ($49/month) – Core analytics and basic market data
✓Pro+Alerts ($149/month) – Advanced analytics with email alerts via SendGrid
✓Enterprise API ($499/month) – API access and advanced integrations

OddsWire is a data analytics platform only. We do not accept wagers, hold customer funds, facilitate gambling transactions, or provide gambling advice. Users are responsible for their own interpretation of data and any trades they execute on third-party platforms.

2. Eligibility

You must be at least 18 years of age to use OddsWire. By using the service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are accessing OddsWire on behalf of a business entity, you further represent that you have authority to bind that entity to these terms.

3. Account Terms

3.1 Registration

To use OddsWire, you must create an account by providing accurate, complete, and current information. You agree to maintain the confidentiality of your account credentials and are responsible for all activity that occurs under your account.

3.2 One Account Per Person

You may create only one account per person. Creating multiple accounts to circumvent usage limits, evade restrictions, or otherwise violate these terms is prohibited. OddsWire LLC reserves the right to terminate accounts that violate this policy.

3.3 Account Security

You are responsible for maintaining the security of your login credentials. You agree to notify us immediately of any unauthorized access to your account. OddsWire LLC is not liable for any loss or damage resulting from unauthorized access due to your failure to protect your credentials.

4. Subscription and Payment

4.1 Billing

Subscriptions are billed monthly in advance. Payment is processed through Stripe. By providing payment information, you authorize OddsWire LLC to charge your payment method for the subscription tier you select.

4.2 Auto-Renewal

Your subscription automatically renews each month unless you cancel it. You can cancel at any time through your account settings, and cancellation takes effect at the end of your current billing cycle.

4.3 Refund Policy

OddsWire does not offer refunds for partial months or canceled subscriptions. If you cancel mid-month, your access continues until the end of your current billing period, but no prorated refund is issued. Refunds for service errors or disputes should be requested in writing to hello@oddswire.bet within 30 days of the charge.

5. Acceptable Use

You agree not to engage in any of the following activities:

✓Web scraping, crawling, or automated access to OddsWire (except through authorized API for Enterprise tier)
✓Redistributing, republishing, or reselling OddsWire data without explicit written permission
✓Reverse-engineering, decompiling, or attempting to derive the underlying data or algorithms
✓Using the service for illegal activities or in violation of any applicable laws
✓Harassing, threatening, or abusing OddsWire LLC personnel or other users
✓Introducing malware, viruses, or malicious code into the platform

6. Intellectual Property

All content, features, and functionality of OddsWire (including software, analytics algorithms, and compiled data) are the exclusive property of OddsWire LLC or its licensors, protected by copyright, trademark, and other intellectual property laws. Your use of the service does not grant you ownership of any intellectual property rights.

You retain ownership of any data you provide to OddsWire, such as your trading activity or custom parameters. However, you grant OddsWire LLC a license to use such data to improve the service and provide analytics.

7. Disclaimers

OddsWire is a data analytics tool and does NOT provide gambling advice, investment recommendations, or guaranteed outcomes. All use of the service is at your own risk.

✓Past performance, historical data, and predictive models are not guarantees of future results.
✓Market conditions change rapidly; data may be delayed or contain errors.
✓You alone are responsible for any financial decisions made based on OddsWire data.
✓OddsWire LLC is not liable for losses, missed opportunities, or damages resulting from your use of the service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ODDSWIRE LLC SHALL NOT BE LIABLE FOR:

✓Any indirect, incidental, special, or consequential damages
✓Lost profits, lost revenue, or lost business opportunity
✓Data loss, service interruptions, or system failures
✓Any damages exceeding the amount paid by you in the 12 months preceding the claim

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Data and Privacy

Your use of OddsWire is governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. We use error monitoring via Sentry to improve service reliability. By using OddsWire, you consent to the data practices outlined in our Privacy Policy.

10. API Terms (Enterprise Tier)

Enterprise tier subscribers gain access to OddsWire's API. The following additional terms apply:

10.1 Rate Limits

API access is subject to rate limits. Exceeding these limits may result in temporary suspension of access without liability to OddsWire LLC. Limit details are provided in the API documentation.

10.2 No Redistribution

Enterprise tier API data must not be redistributed, resold, or shared with unauthorized third parties. Violation will result in immediate termination and potential legal action.

11. Termination

OddsWire LLC may terminate or suspend your account at any time for violation of these terms, non-payment, or other harmful conduct. You may cancel your subscription at any time through your account settings.

Upon termination, your access to OddsWire ceases immediately. No refunds are issued for the current billing period. Any data you uploaded remains property of OddsWire LLC as permitted under Section 6.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States, without regard to its conflict-of-law principles. Any legal action or proceeding shall be resolved in the federal or state courts located in the United States.

13. Changes to Terms

OddsWire LLC reserves the right to modify these Terms of Service at any time. Material changes will be announced at least 30 days in advance via email or prominent notice on the platform. Your continued use following such notice constitutes acceptance of the modified terms.
